1.13 PASSPORT AND VISA

1.14 PRICES

Your reservation is only confirmed after full payment has been received. Each service has different payment terms and obligations. Tourwix has the right to update the tariffs and refuse the reservation. You are responsible for making the necessary payments on time. 1.15 ONLINE SALES CONFIRMATION

Services are offered on our website under the assumption that they are available. Tourwix has the right to cancel within 24 hours after receipt of the online reservation (in the event that the service is not available). In the event of cancellation by Tourwix, you will be refunded the amount that was paid. For this reason, we strongly recommend that you wait for the confirmation reservation via email. 1.16 CANCELLATION POLICY

If the reservation has not been paid for in full, we have the right to cancel your reservation.

2.1. PARTIES

2.3. APPLICATION

A - The date of the overnight stay in the hotel is specified in the hotel voucher. The people who will be staying at the hotel will be registered with the name of the "customer".
 
B - The customer will spend the night in the named hotel, certain room type and food and drink concept.
 
C - The customer will stay at the hotel for the specified period. In the case of extension requests, Tourwix can extend the overnight stay in the hotel after the customer has submitted the application and paid.
 
D - While the customer is staying in the hotel, Tourwix is not liable for loss, damage or theft of customer property.
 
E - The customer's check-in time at the hotel is 2:00 p.m. The latest time to leave the hotel is noon.
 
F - It is assumed that the customers who do not have a contract signature but participate in the contract-related service have accepted and promised the terms of the contract after reading and signing this contract by the customers who instruct them to register on their behalf to have. Tourwix reserves the right to resort to other consumers in order to collect the excess amount or service fee paid to the customers who signed the contract.

G - The customer has the right to withdraw from the contract by refusing the service within 7 days from the date of receipt or signing of the contract without any legal or criminal liability and without justification, and has the right to terminate the service from the date withdraw the receipt of the cancellation policy from Tourwix. When booking in times like: early bird - New Years - Holidays - Semester etc. the return policy will not have the right described in this article.


2.4. DEADLINE AND TERMINATION

A - The customer is obliged to send all cancellation requests in writing to Tourwix before the start of the service. If the service received is a product within the campaign, this article is invalid.
 
B - Unless the customer declares in writing 8 days before the requested change to the prepaid reservation, the types of accommodation specified in this contract are valid.
 
C - If the customer requests cancellations and changes between 8 and 15 days from the date of the reservation, 35% of the amount paid will be deducted as withdrawal compensation. If you request a cancellation or change on the 16th day or later from the date of reservation, no refund will be given.

D - If the customer does not give written notice that he will be participating in the service he missed; Tourwix reserves the right to cancel all reservations and services made on behalf of the customer after 24 hours. No refund will be given to the customer for such cancellations.
 
E - The amount paid for the reservation will be refunded to the customer in the event that he or his relatives in the first degree document the inconvenience and death of 10 days of habitual employment with an official report from the full-fledged state hospital.
 
F - Tourwix can partially or completely change and cancel the announced or registered hotel reservation up to 7 days before the start date, 1 day in special days and / or periods, provided that the consumer is notified if this is deemed necessary. If the customer does not accept these changes and cancellations, they have the right to cancel the reservation and receive a full refund of the fee paid. In this case, the customer is not entitled to any compensation.


2.5. CANCELLATION AND OTHER PROVISIONS

A - It is the customer's responsibility to inform Tourwix in writing of the respective complaints while the service is being provided. If you use the service to the end, despite a complaint, without notifying Tourwix, the rights to compensation such as replacement service and reimbursement of costs will lapse.

B - The customer can insure the costs for cancellations in the event of accident and illness as well as the damage and treatment costs that arise as a result of an accident before the start of the trip (travel cancellation insurance). The coverage of cancellation damages is based on the policy of the insurance company with which you have taken out the travel insurance. Tourwix assumes no responsibility for the content, scope or application of the insurance.
 
C - Even if the customer has not signed this hotel reservation contract for any reason but has bought it through a mail order, payment by credit card or bank transfer, he has the terms of this contract, which are valid between the parties, through the catalog that Website or advertisements and commit to this contract by paying.
 
D - The customer has read all kinds of information about the hotel, which is mentioned in this contract, on the Tourwix website or received it from Tourwix sales representatives, asked all necessary questions and signed this contract. Tourwix has announced all information and services from the hotel through the hotel brochure, official website of the hotel, information of the star rating as well as the qualifications and standards to the customer, Tourwix is not liable for any incorrect information from the hotel.
Liability is exclusively the responsibility of the hotel facility. In the event that the hotel facility does not meet the prescribed standards or cannot provide a service according to this standard at the time of accommodation, Tourwix has the right to reserve and accommodate the customer in a facility of the same standard or a higher category. If the customer does not accept such a change, he has the right to withdraw the total price paid for his reservation.

E - If you do not enter the hotel without canceling, the hotel costs will not be refunded. If the force majeure is documented in cases such as death, illness, accident, the costs for the periods not remaining will be reimbursed. In the event of late check-in or early check-out for any reason other than these, the remaining time will not be refunded.
 
F - When registering at the hotel on the day of arrival, all customers must present their identity card or passport. Control over age is checked. If incorrect or incomplete travel data is transmitted to Tourwix, the hotel will collect a certain surcharge from the customer at the time of arrival. Tourwix is not liable for the additional costs.
 
G - The period specified in 2.3 G does not apply during the early bird season. Cancellations and changes only apply to customers who have reasons of force majeure (reported death, illness and accident).
 
H - At the time of registration, at least 35% of the hotel costs and the balance must be paid at least 15 days before the start of the trip. If the specified payments are not made within the specified deadlines, the reservation will be canceled and the customer will be charged 35% of the service fee as compensation. If the service received is a product within the campaign, this article is invalid.

I - In the case of early booking times and / or all periods, the difference will not be requested from the customer in the event of a price increase (with the exception of system-related errors) and there will be no reimbursement for the discounts specified by the hotel as a promotion.
 
J - The scope of coverage for incomplete or inadequate services, damage and loss for customers who take out travel insurance is based on the policy of the insurance company providing the service. Tourwix assumes no responsibility for the content, scope or application of this insurance and guarantees.

L - In the event of changes and requests regarding the travel date, room type or hotel, the service fee specified by the agency or hotel will be charged for each change / request.

M - The client's request for early departure after the start of the accommodation is made in writing, including the reason for the complaint and force majeure, and will be assessed according to the hotel's approval. In the event of early departure, it is up to the cooperating hotel to issue a refund or not. Therefore, Tourwix cannot be challenged with a request in this regard. All applicable penalties will be charged to the customer as an accommodation fee.
 
N - If the customer has a complaint regarding the hotel, the customer must first inform the hotel of any dissatisfaction and then identify the hotel as the counterparty in the lawsuit and the complaints they have submitted. The customer cannot make financial, moral compensation or inquiries to Tourwix.


2.6. CONTRACT PRICE AND PAYMENT

A - The contract price includes VAT. The customer is obliged to pay the entire contract price.
 
B - Tourwix is entitled to obtain bookings from the bank that are purchased with the customer's credit card.
 
C - The reservation details and types are determined before payment is received.
 
D - In the event of disputes between the parties that may arise from this contract, the courts of Antalya / Turkey and enforcement offices are responsible.

3.1. FLIGHT TICKET RULES

A- All reservation, ticket sales, cancellation and modification transactions in connection with the ticket purchased through tourwix.de are ARTMODERN UG and Tourwix Tur. Yön. Danş. Org. İnş. Taş. 3.2. FLIGHTS

3.2.1 LINES FLIGHTS

A- Please pay special attention to the additional conditions, apart from the ticket fees. Some tickets cannot be changed and / or refunded.
 
B- In addition, the airlines reserve the right to change flight cancellations and to cancel confirmed reservations. D- The flight route indicated on the ticket should be used in the correct order. Continuing or missed flights can invalidate the ticket entirely.
 
E- Affordable, cheap or special ticket prices may not always offer the shortest and most direct flight. Some routes may require you to change aircraft. Direct flight is defined as a non-stop flight. 3.2.2 LOW COST AND WITHOUT SERVICE FLIGHTS (Low Cost Airlines)
Low cost airline tickets booked through the tourwix.de website cannot be canceled and are non-refundable. The terms and conditions are subject to the airlines. Please note that low cost flights only depart from different airports.


3.2.3 CHARTER FLIGHTS

In accordance with the Warsaw Convention, which regulates the rules for charter flights, airlines operating charter flights are entitled to make changes in timing. Flight time cannot be guaranteed. 3.3. WARNINGS

4.1. PARTIES

4.2. CONTENTS

4.3. SERVICE AND PAYMENT INFORMATION

4.7. GENERAL PROVISIONS

A. Passengers must be buckled up in accordance with traffic regulations.

B. The booking must be made at least 8 (eight) hours in advance of the transfer in order to benefit from the contractually agreed transfer service.

C. Reservations must be made no later than 24 (twenty four) hours prior to the time of transfer on religious and national holidays, New Years Eve and other public holidays.

D.The reservation can be canceled by the customer no later than 12 hours before the transfer time. In this case the customer will be reimbursed the costs. No refunds will be given for later cancellations.

E. The route to be followed during the transfer service from the point of departure to the point of destination; It is determined exclusively by "tourwix.de" taking into account traffic, road conditions and other criteria. The customer is not authorized to change this route. In this regard, requests from the passenger to stop at a different location between the specified route and take a short break at that location are accepted. "tourwix.de" is obliged to reach a certain point between the two routes indicated.

F. "tourwix.de" does not accept bags, chests, packages, etc. that are used as luggage during the transfer process. The passenger has a maximum of 1 baggage allowance per person. If the undeclared luggage is lost or damaged, the customer is not entitled to the service fee as material and moral compensation.
It is forbidden by law to carry goods in luggage that are: flammable, explosive, drugs, dangerous liquids, radioactive.

If the driver discovers legally prohibited items in the baggage, the baggage will not be taken into the vehicle. A refund will not be given if the following 15 (fifteen) minutes are exceeded during the evacuation of the above-mentioned items from the baggage, the transfer does not take place for these reasons or the customer cannot reach the flight due to the lost time. In addition, in these cases the customer cannot assert any claim or claim against "tourwix.de" under any name.

In the luggage; If the presence of the above substances is detected, the situation will be immediately reported to the competent authorities by "tourwix.de". The driver does not notice the presence of the counted items; If it is detected by law enforcement agencies stopping and searching the vehicle during the transfer; For this reason, all types of damage and losses are immediately covered and reported by the customer in cash.

G. In the case of transfer requests from the customer with pets and the type of pet to be transported, the customer must provide information when booking online. No pet transfers will take place without this notification. No pet transfers will be made without an adult customer. Under these conditions, the animal to be transferred can only be transported in its special cage in the section indicated by the staff "tourwix.de" in the vehicle under all responsibility of the customer. The passing on of animals whose acquisition, possession and passing on are illegal is not possible under any circumstances.

H. For a transfer from a certain point to the airport, "tourwix.de" declares and undertakes that the vehicle assigned for the transfer is at the specified point at the time of the transfer. A delay of 20 (twenty) minutes from the transfer time will be considered a reasonable delay. If the delay is more than 20 (twenty) minutes, the customer does not have to wait for the vehicle. In this case the transfer fee will be refunded to the customer.

I. At certain locations such as condominiums that have security at the entrance, "tourwix.de" is not liable if the delay time of 15 (fifteen) minutes is exceeded, as the security will prevent you from entering the location. If the 15 (fifteen) minutes is exceeded in this way and the customer does not wait for the vehicle, no refund will be given.

J. The customer must be present with their luggage at the designated place at the time of transfer. If the customer is not present at the transfer point at the time of the transfer, the vehicle assigned to "tourwix.de" must wait 15 (fifteen) minutes for the customer. If the customer does not reach the specified point with his luggage after 15 (fifteen) minutes, the vehicle does not have to wait any longer.

K. At the transfer point, the staff of "tourwix.de" is not obliged to accompany the luggage, the animal cage and the transferred passenger to the vehicle.

L. Transmission of children under the age of twelve does not occur without their adult companions. The companion's return trip to the destination depends on the purchase of the return transfer on the website.

M. If a customer requests a transfer with a wheelchair, this must be communicated by the customer when booking online.

N. When booking online, a child seat can be booked in the vehicle, which "tourwix.de" determines for 50 TL or 5 € as an extra cost.

4.8. FORCE MAJEURE

All types of force majeure, natural events, adverse climatic conditions, social events, popular movements, events due to negative developments in working life, all kinds of legal or illegal employee or employer movements, strikes, lockouts, trade union movements and in the event of non-performance of their contractual obligations due to Business slowdowns, war, armed conflict, revolution, tight management or state of emergency, intergroup conflict and civil unrest, this contract will be suspended until the stated situations / negative effects end. The contract comes into force again with the end of the mentioned situations / negative effects. Failure of the parties to meet their obligations due to force majeure does not entitle the other party to termination or compensation.

4.9. CANCELLATION POLICY AND OTHER PROVISIONS

The service booked by the customer cannot be canceled, changed or refunded for any reason. Requests to the bank or "tourwix.de" for the cancellation and refund of reservations whose date and time have expired are invalid.

4.10. AUTHORITY

In the event of any dispute arising from the implementation of this contract, the laws of the Germany Republic and Turkey will be applied and the courts and law enforcement agencies of Stuttgart and Antalya will be authorized.

4.11. ENFORCEMENT

Customers who do not have a contract signature but who receive the contractual service accept the contractual conditions by reading this contract and making an online reservation through the third party authorized to register on their behalf. In the event of disputes arising from the contract, the Road Traffic Act No. 4925 and other Turkish legal provisions apply. Antalya courts and law enforcement agencies are authorized. I have read, understood and accepted the entire contract, the date and time of departure, the Road Traffic Act number 4925 and the information on the website, and I have received a copy of this contract made out on our behalf.

5.1. PARTIES

ARTMODERN UG (Haftungsbeschränkt) and TOURWİX TUR. YÖN. DANŞ. ORG. İNŞ. TAŞ. TİC. LTD. ŞTİ. is referred to as "Tourwix.de" for short. By accepting this contract, you accept the travel conditions of the travel agency Tourwix.

5.2. CONTENTS

In accordance with the provisions of the Consumer Protection Act No. 4077, as amended by Act No. 4822, and the Regulation on the Application Procedure and Principles of Distance Contracts, a contract for online sales should be drawn up.

5.3. GENERAL PROVISIONS

5.3.1. tourwix.de will inform the customer of the tour date and duration, the name of the package / day tour, the tour price, the total payment received and the payment method, the route, the hotel names, the means of transport, the departure times and their places of departure, if these correspond to the standards set out in the program. tourwix.de reserves the right to change the tour or transfer it to another agency upon notification. The tour programs specified during registration are general programs. The days on which the excursions specified in the tour programs are organized can be changed at the initiative of the tour guide. The customer agrees that the travel conditions are met, the overnight stay will not be shortened and the classes and categories of accommodation will not be changed.

5.3.2. The participating customer has the right to take 2 suitcases with them, provided that they are no larger than 50 cm x 70 cm for all types of trips. For trips with a stay of three nights, up to 20 kg of luggage is allowed. All responsibilities for baggage and the items it contains rests with their owners.
 
5.3.3. Objects that smell, are liquid and flammable or explosive and make the environment uncomfortable as well as cutting, stabbing, firearms and all kinds of animals are not permitted in vehicles and accommodations without the express and written consent of the agency.
 
5.3.4. In the event of loss or damage to the luggage due to serious negligence of the agency staff, regardless of the material and moral value of the items in the damaged luggage and other qualifications and characteristics, 50% of the total cost of the trip will be paid to the customer by the agency. The agency is liable for all types of loss, damage and theft of goods reported by the customer in writing, together with their value and the participant's transport costs.
 
5.3.5. The tour does not include the cost of visa procedures and services.
 
5.3.6. Notification of the cancellation of the booked tour by the agency can be given individually in writing to each customer or to the group leader in the case of group reservations with a general announcement.

5.3.7. The agency is responsible for reasons other than force majeure that will occur after the start of the tour program purchased by the customer. The agency can compensate the customer for the changes in the form of a price or service refund in accordance with the provisions of the TÜRSAB Kütahya schedule and compensate the customer with additional and / or alternative agreements not included in the price. Through the purchase and use or consumption of additional or replacement services by the customer, the customer's right to reimbursement and compensation no longer applies.
 
5.3.8. If the customer leaves the tour because the service is faulty, he must inform the agency representative and the hotel that he has left the tour with the reasons in writing. Otherwise, it will be assumed that the customer did not leave the tour and purchased and used the service.
 
5.3.9. It is the duty of the well-intentioned customer to inform the agency in writing of the complaint while the service is being provided. By using the service to the end, the customer does not have to complain and thus has no claim for damages or compensation and reimbursement of the costs.

5.3.10. It is assumed that the customers who do not have a contract signature but are participating in the contract-related tour have accepted and promised the terms of the contract when this contract is signed by the customers who have asked them to register on their behalf. However, if the customer took part in the trip and did not personally sign the contract, in the event of legal disputes and follow-up measures in connection with the travel agency and the agency, the excess amount of the customer who signed can fall back on. The terms of this contract are in accordance with the provisions of all parties, including those customers who have not signed on the basis of the brochure, catalog, website, participation form and the advertising agreed to participate in the trip.
 
5.3.11. The agency acts as an intermediary for customers taking part in the trip, hotels, airlines as well as third parties and legal entities who provide other travel-related services. The suppliers who take over the contract-related tour of the customer have their own agreements for each service. Thus, delays in departure times, flight times, land, air and sea vehicles of all kinds, strikes, terrorism, war or similar violence can be attributed to personal negligence of third parties or unforeseen technical problems, the agency is not responsible for accidents, incomplete or faulty services in the case of hotel accommodation, since the agency is not the operator and is not directly responsible as the main debtor. For this reason, the agency is not a joint and several debtor towards the customer. In the event of such faulty services or an accident, the customer will first obtain his material and moral demands from the supplier. In cases in which the supplier does not fully meet his claims, the amount can be requested from the agency.

5.3.12. Tourwix forwards customer inquiries regarding room types to the hotel management. However, it cannot be guaranteed that the request will be 100% fulfilled. On the day of arrival at the hotel, rooms cannot be made available to customers before 2 p.m. On the day of departure from the hotel, customers must vacate their rooms by 10:00 a.m. at the latest.
 
5.3.13. You can book the booked tour in cash, by credit card, or by bank transfer. If payment is not made by credit card, the customer is obliged to contact his bank. Tourwix is not responsible for a non-incoming transfer.
 
5.3.14. Tourwix mainly offers day tours. When reserving and participating in such tours, it means that you consider and accept the following possible dangers due to the uncertainties and dynamics of nature. Any injury, illness, loss of property or damage to property, discomfort, etc. during the tour are requirements that should be accepted on nature tours. Flexibility and alternatives form the philosophy and basis of this type of travel. By participating in one day tours, you acknowledge and accept that the conditions listed above are possible and that these events can lead to dissatisfaction. However, we recommend that you take out comprehensive health and accident insurance under all circumstances. In the event of injury or death, Tourwix is only liable for the insurance it has taken out as a legal obligation. The task of Tourwix is to take the participant to the nearest health center under the most favorable conditions in such emergencies and to activate their insurance.

5.3.15. You must comply with the group leader's requirements, especially on day tours. If the requirements are not complied with, which disrupts the course of the tour or harms other group members, the tour loses your right and your relationship with the tour in cases in which you endanger the health of others and will be interrupted with a written report. In this case, you are not entitled to any compensation.
 
5.3.16. All of our activities are group activities. The focus is on the success and safety of the group. Individual behaviors are not allowed. The group leader is the only authority throughout the tour. If the group leader believes that your health or general behavior is causing problems with the health, togetherness, general structure, safety and peace of the group, you may be asked to leave the tour. In such cases, the leader prepares the written report and has the other group members sign the report. The person asked to leave the group is not entitled to any compensation.
 
5.3.17. For a tour or trip organized by our agency, e.g. Photos, camera images are used for advertising and promotions. The persons whose pictures are used for marketing purposes cannot claim any rights based on the picture.

5.3.18. Venvoas Travel is obliged to treat the information of the participants confidentially. The parties accept Tourwix records as final evidence of any dispute. The Antalya courts and law enforcement authorities are authorized to deal with disputes that may arise from this contract.
 
5.3.19. 1618 SY., 4077 SY., 4288 SY., 2634 SY., IATA IH, provisions of the UFTAA convention, civil aviation law, UK., TCC., Turkey, are incorporated into the international conventions and depending on their provisions, statutes, regulations , Circulars and notices with internationally recognized Frankfurt table applied to the application of the provisions of the items found in Turkey TÜRSAB Kütahya.
 
5.3.20. If the agency does not comply with the contract in part or in full, the items in the TÜRSAB Kütahya diagram (TÜRSAB TOURISM CONSUMERS ASSESSMENT SCHEDULE) will be used to calculate the compensation to be paid.

5.4. PAYMENTS

At the time of registration, at least 30% of the booking fee must be paid 15 days prior to departure. If the specified payments are not made within the above deadlines, the reservation will be canceled. In this case, the customer will be charged 30% of the travel price as compensation.

5.5. REGISTRATION-CANCELLATION-TRANSFER CHANGES

5.5.1. The agency may cancel the trip due to insecure registration as well as the required number of passengers and / or adverse weather conditions, road block, strike, terrorism, war, possibility of war, unforeseeable technical problems and force majeure that prevent the start or continuation of the trip. In this case, the customer has no right to compensation.
 
5.5.2. A-If the customer requests a cancellation change up to 15 days prior to departure, the full fee will be refunded.
 
B-If the client requests a cancellation change less than 15 days before the start of the trip for any reason other than the documentation of the discomfort and death of his first degree relatives with the official report obtained from the full-fledged state hospital for 10 days, 35% of the Refunded travel fee. If it is less than 7 days, the customer accepts and undertakes to pay the entire price of the trip to the travel agency Tourwix. C-When booking a service in the early bird season, Tourwix may charge 35% of the total cost of the total cost 7 days prior to departure if a cancellation request is made for any reason. If less than 7 days before departure, the customer must pay the total costs to Tourwix.
 
D-In cases where a deposit is made to a tour, your registration is considered complete. In the event of incomplete payment up to 7 days before the start of the trip for tours with more than two neighbors, up to 3 days before the start of the trip with less than two nights and 24 hours before the start of the trip for day tours, participation in the tour will be canceled by the agency. The space reserved for the customer for the tour is made available for sale. All responsibility of the participant who paid a deposit for a tour remains. After the deposit has been invoiced, the remaining fee is due. These deadlines can be extended or shortened by agreement of the parties.
 
E- The participant is not deemed to have made a final reservation until the tour participation fee is paid in full.
 
F-changes to the date of the tour can only be made under the following conditions:
  • If you do not risk the minimum number of participants conditions.
  • If the tour for which you are registered is suitable in all respects and does not cause any organizational problems for Tourwix, this can be realized. Otherwise you will have to pay the fixed no-show fee.

G- Switching to another tour on the same day can only take place under the following conditions:
  • If you do not risk the minimum number of participants conditions.

H-Due to the fact that not every tour is active and our quotas are limited, the tour reservations made on our website are confirmed in a controlled manner. When you make a reservation for one of our tours on the website, your reservation will be confirmed by a reservation confirmation from Tourwix. Therefore, your reservation will not be finalized without our reservation confirmation. In other words, the reservation you have made on our website is not a final reservation until you receive the reservation confirmation.

I-Tourwix reserves the right to correct the amount if necessary, request further payments or refund, due to errors on the website. In such cases, the stated sales price of the tour will be taken into account, not the amount paid.
 
J-In the event of cancellations, the cost of charter flights cannot be refunded before 15 days or later.
 
K-Name changes can be made up to 7 days before charter flights. However, no name changes can be made for scheduled flights. If the consumer loses his ticket, he is obliged to pay the penalty demanded by the airline concerned.
 
5.5.3. The customer can transfer the booked tour to another person up to 7 days before the start of the tour. The transferor and the transferor are responsible for the costs arising from the balance and the transfer.
 
5.5.4. Tourwix reserves the right to cancel all reservations made on behalf of the customer 24 hours after the start of the trip, unless the customer notifies him in writing that he will take part in the trip that he missed. No refund will be given to the customer for such cancellations.

5.5.5. Tourwix can partially or completely cancel the announced or registered tour up to 7 days before the start of the trip, provided that the customer is notified if he deems this necessary. Within the same period, the names of the hotels in the context of the trip, the transport vehicles and their places of movement, as well as the order of visits to the places indicated in the program and indicated as places to be visited may be changed. If the customer does not accept these changes and cancellations, they have the right to cancel the reservation and receive a full refund. In this case the customer is not entitled to any compensation.
